Terms and Conditions for Nextor Marketplace LTD

By accessing or using the Marketplace, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Marketplace.
1. Marketplace Overview
  • The Marketplace is an online platform connecting buyers with vendors ("Vendors").
  • We facilitate transactions between buyers and Vendors but are not a party to any transaction.
  • All transactions are solely between the buyer and the Vendor.
2. Vendor Responsibilities
  • Vendors are responsible for accurately listing their products, including descriptions, prices, and availability.
  • Vendors must comply with all applicable laws and regulations, including those related to product quality, safety, and labelling.
  • Vendors must fulfil orders promptly and provide accurate shipping information to buyers.
3. Buyer Responsibilities
  • Buyers are responsible for reviewing product listings carefully before making a purchase.
  • Buyers must provide accurate shipping information and promptly communicate any issues or concerns with their orders.
4. Product Information
  • We strive to provide accurate and up-to-date product information on the Marketplace. However, we do not warrant the accuracy, completeness, or reliability of any product information.
  • Product images may differ from the actual product. We recommend reviewing product descriptions and specifications provided by the Vendor.
5. Pricing and Payment
  • Prices listed on the Marketplace are set by Vendors and may vary between listings.
  • Buyers agree to pay the total amount specified at checkout, including the cost of the product and any applicable taxes and shipping fees.
  • Payments are processed securely through our payment gateway. We do not store or have access to your payment information.
6. Order Fulfilment and Shipping
  • Vendors are responsible for fulfilling orders promptly and providing accurate tracking information to buyers.
  • We are not responsible for delays or issues with order fulfilment, shipping, or delivery. However, we will assist buyers in resolving disputes with Vendors to the best of our ability.
7. Returns and Refunds
  • Each Vendor sets its own return and refund policies. Buyers should review the Vendor's policies before making a purchase.
  • We facilitate returns and refunds according to the Vendor's policies. Buyers must contact the Vendor directly to initiate a return or refund request.
8. Intellectual Property
  • All content and materials on the Marketplace, including product listings, images, and logos, are the property of Nextor Marketplace LTD or its licensors and may not be used without permission.
9. Limitation of Liability
  • To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Marketplace and your use thereof.
  • In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Marketplace.
10. Modifications to Terms
  • We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Marketplace.
  • Your continued use of the Marketplace after the posting of revised Terms constitutes your acceptance of the changes.
11. Governing Law
  • These Terms shall be governed by and construed in accordance with the laws of the Abu Dhabi Global Market (ADGM), without regard to its conflict of law provisions.
